The FTC wants to regulate AI for ideological bias

The Federal Trade Commission wants to start regulating ideological bias in AI systems and assert federal control over state laws. They’re getting an earful from opponents on all sides of the political spectrum.

In a proposed policy statement released last month, the FTC said it was considering treating ideological bias in AI systems as an “unfair and deceptive practice” under Section 5 of the FTC Act.

The commission argued that consumers have an expectation that AI systems will provide them with information free from bias or ideological manipulation. Defining such bias as an unfair or deceptive practice would potentially allow the commission to regulate training or inputs that power AI algorithms. How precisely the FTC would determine when ideological bias exists in these systems is not fully explained in the document. 

Additionally, the statement suggests that the FTC believes this regulatory authority supersedes state AI laws. It specifically mentions the Colorado AI Act, which calls for models to be subject to risk assessments, transparency disclosures and “bias audits” before release. State lawmakers are now seeking to delay or eliminate the audits before the law takes effect in 2027.

CyberScoop reviewed dozens of public comments criticizing  the FTC’s proposal. Even ideological allies raised two main concerns: first, that the proposal distracts from real questions about the federal government’s role in regulating AI deception; and second, that it opens a Pandora’s Box by enabling political censorship of AI model outputs.

Leah Siskind, a former White House digital official and deputy director of the AI Corps at the Department of Homeland Security, told CyberScoop that AI companies face legitimate questions about their obligations to consumers, particularly whether they must ensure their models provide accurate information and protect against deliberate manipulation. 

Siskind’s past research has focused on how authoritarian propaganda tends to be overrepresented in answers provided by large language models, in part due to governments’ intentional efforts to poison data ingested by AI systems.

“There is a really interesting debate here about bias and about accuracy in models and whether that’s deceptive or not… about how we counter disinformation that has been absorbed and is now being reflected by LLMs…but this is not addressing that at all,” said Siskind, now a senior AI fellow at the Foundation for Defense of Democracies.

Instead, Siskind said the FTC statement appears primarily concerned about a power struggle with states over AI regulation and “petty squabbles about which AI model is more woke than the other.” She’s skeptical that the policy statement’s cited legal authorities are on sound footing.

“The way I see it is that the FTC’s role is to police consumer protection violations, not regulating AI systems, and it seems like they’re trying to solve a lack of congressional AI regulation by stretching section 5 [of the FTC Act] well beyond its traditional role,” she said.

Additionally, the policy statement’s language and sourcing suggests that the FTC is concerned with certain kinds of ideological bias more than others.

Anthropic, which has clashed with the Trump administration over AI guardrails and military applications of their technology, shows up more than half a dozen times in footnotes, many which are framed as examples of ideological bias the FTC is seeking to stamp out.

By contrast, the statement ignores a direct example of an American AI company owner influencing their model’s ideology: Elon Musk and his xAI-owned Grok model. Musk has publicly admitted, often on his own website, to intervening when Grok’s responses upset him. These interventions have shaped Grok’s outputs on specific topics, including South African race relations and the term “MechaHitler,” where the model now reflects Musk’s personal views.

But neither Musk and xAI are mentioned in the document, while Grok appears in a footnote which cites an advertisement for Grok as “your truth-seeking AI companion for unfiltered answers with advanced capabilities in reasoning, coding, and visual processing.”

Criticism across the spectrum

The FTC received more than 300 comments on its proposal from trade associations, think tanks, individual experts and members of Congress. Most criticized it as ill-defined and vulnerable to politically-motivated censorship, while some supported stronger rules against bias in AI systems. 

The International Center for Law and Economics noted the statement “offers little practical guidance about how the Commission will apply its deception authority to AI” and also does little to address hard questions, like where AI providers may be exercising their own First Amendment-protected activities.

The statement’s “focus on ‘ideologically motivated distortions’ suggests that the Commission’s concerns extend beyond factual misrepresentations in marketing to speech that may receive the highest degree of First Amendment protection,” the ICLE wrote.

The America First Legal Foundation, a conservative non-profit founded by top White House adviser Stephen Miller, pressed the FTC to adopt the policy “in full,” claiming that frontier models from OpenAI and Anthropic “have been programmed to prioritize ideologically liberal and progressive values as though they are objective, neutral positions rooted in truth.”

The group also argues that regulating these models’ ideological output falls under the FTC’s legal authority, because a “reasonable consumer” would expect that a model advertised for its usefulness and reliability would not prioritize liberal, ideological views.

“A reasonable consumer, based on AI companies’ advertising choices, would not expect that an AI system will adopt overwhelmingly liberal positions, thereby skewing results, or adopt a moral framework that would prefer to annihilate the earth rather than utter a slur,” wrote Emily Percival, senior counsel for America First Legal.

However, comments from other conservative groups questioned that rationale. The R Street Foundation’s Spence Purnell and Adam Thierer wrote that “the consumer expectations rationale is typically used in cases where there is an omission of information that should have existed.”

“Given that most LLMs already have disclosure statements [for their outputs], it seems unlikely that the FTC could explicitly prove that consumers were deceived about a product,” Purnell and Thierer wrote.

Reps. Josh Gottheimer, D-N.J., and Michael Lawler, R-N.Y., urged the FTC to carve out civil rights-related work from their scrutiny, such as preventing models from discriminating against users based on race, religion, gender, age and other federally protected characteristics.

“AI companies must not falsify facts in the name of fairness, but they also must prevent discrimination, stereotypes, and unequal treatment,” Gottheimer and Lawler wrote. “We would appreciate understanding how the FTC intends to ensure that these efforts remain permissible under the final policy framework.”

But the most common concern shared across the political spectrum was that the FTC could establish a precedent allowing the Trump White House and future administrations to reshape AI systems to reflect their political views.

David Inserra, Jennifer Huddleston and Juan Londoño of the Cato Institute point out that the FTC statement is conflating two different issues: ideological bias in AI systems and factual deception in marketing. 

“In other words, the FTC is trying to judge AI models’ accuracy and performance—two largely subjective variables—in the same way it evaluates dietary supplements’ medical-benefit claims or users being charged fees without proper notice or consent,” they write. “This is an absurd comparison.”

NATO and an AI startup can now name and track software vulnerabilities

NATO’s cyber defense arm and a startup that uses artificial intelligence to find software flaws can now issue the ID numbers the industry uses to track those flaws, the European Union Agency for Cybersecurity announced last week

The NATO Cyber Security Centre, part of the NATO Communications and Information Agency, and AISLE, a cybersecurity company with offices in San Francisco and Prague, joined as CVE numbering authorities under the ENISA Root. The CVE program assigns a unique record to each publicly disclosed security flaw so that governments, vendors and researchers have a common marker when referring to particular vulnerabilities. 

Twenty numbering authorities now sit under the ENISA Root, with 12 brought in by ENISA itself and eight moving over from the MITRE Root, run by the U.S. nonprofit that has handled the program’s daily work for more than 20 years.

Hans de Vries, ENISA’s chief cybersecurity and operations officer, linked the growth to changes in how people find flaws. 

“Recent developments in the global cybersecurity landscape, coupled with the emergence of Frontier AI models and their impact on vulnerability discovery and exploitation, have underscored the need to build strong vulnerability management infrastructure and capabilities,” he said in a statement. He said ENISA’s role helps build a “more globally representative, resilient, and scalable vulnerability identification ecosystem.”

The two new members show how bespoke each member is within its authority. The NATO Cyber Security Centre can now assign CVE IDs to eligible flaws across the NATO enterprise. The agency said that will make tracking more consistent and let the alliance share information with trusted partners sooner. The center guards NATO’s networks, watches for threats and coordinates the response when incidents hit.

Meanwhile, AISLE’s authorization is narrower. The company said in a July press release that the designation covers vulnerabilities discovered in its own products, allowing it to publish identifiers without waiting for a third-party authority to process a request. 

Jaya Baloo, the company’s co-founder, described the step as “foundational” and said coordinated disclosure “starts with holding your own products to the same standard you expect of everyone else.” Separately from the designation, the company said its researchers have disclosed hundreds of vulnerabilities in widely used open-source software, including OpenSSL, Linux, Apache and OpenEMR, each coordinated through the relevant authority for that project.

The changes come as the CVE process continues to involve amid program upheaval and the torrent of vulnerabilities discovered by AI systems. 

The CVE program, run by CISA, narrowly escaped a sudden demise when a last-minute, 11-month contract extension averted a shutdown in April 2025. Since then, several competing databases from European nonprofits and other private entities have been stood up in order to better coordinate how vulnerabilities are tracked, disclosed, and ultimately patched.

Earlier this year, The Computer Incident Response Center Luxembourg (CIRCL) launched the Global CVE Allocation System, or GCVE, as an alternative to the CVE program.

U.S., South Korean government agencies caution to be on lookout for Gunra ransomware gang

U.S. and South Korean cyber agencies warned Monday about a ransomware-as-a-service outfit, Gunra, that reportedly recruits ethical hackers and penetration testers and benefits from North Korean government-linked hackers’ tools to target government and critical infrastructure organizations.

Gunra has gone after sectors such as academia, financial services and insurance, government services and facilities, healthcare, manufacturing and construction, media, retail, transportation and utilities. Its global scope is far-ranging, according to Monday’s alert: Africa, the Americas, the Asia-Pacific, Europe and the Middle East.

“Gunra is another variant in the ongoing trend of ransomware attacks causing disruption and harm to U.S. and international organizations,” said Chris Butera, acting assistant director for cybersecurity at the Cybersecurity and Infrastructure Security Agency, which produced the advisory with the Department of Defense’s Cyber Crime Center, FBI, National Security Agency, Secret Service and Republic of Korea’s National Police Agency.

The alert is part of the #StopRansomware series, a joint FBI-CISA project aimed at network defenders.

The FBI first took notice of Gunra in April of last year. The double-extortion group established a data leak site on Tor to list victims and publish purloined data. By January of this year, Gunra had launched a formal ransomware-as-a-service affiliate and was growing in its ambition, Monday’s alert states.

“The FBI observed the group adopting new branding aliases (notably operating under the name Golden Community) to support this expansion,” it reads. “Gunra has further commercialized its platform by actively recruiting penetration testers and ethical hackers to serve as initial access brokers, offering a share of the ransom profits in exchange for enterprise network access.”

Gunra seeks initial access with known vulnerabilities in internet-facing devices like firewalls or virtual private networks, and is based on or influenced by the Conti ransomware code leaked in 2022, according to the agencies.

Research published in July by a South Korean cybersecurity firm took note of Gunra overlap with Lazarus Group, although it doesn’t explicitly mention the latter group’s name.

“These commonalities suggest that although the state-sponsored threat group and the Gunra ransomware group appear to be separate threat actors with different ultimate objectives, they may have shared certain techniques, tools, and infrastructure or collaborated to a limited extent during the attacks,” AhnLab wrote in its report.

That kind of North Korean government-ransomware gang collaboration dates back to at least 2024. Nor is Gunra alone among ransomware-as-a-service outfits recruiting penetration testers.

Capitol Hill wants to know if executive branch, foreign allies coordinated enough to combat scams

Senators from both parties Thursday probed Trump administration officials about whether federal agencies and foreign governments are coordinated enough in the battle against scammers, something witnesses told the Foreign Relations Committee they were working to remedy.

At least 13 federal agencies have authorities to counter scams, raising questions about whether someone needs to be in charge of all those efforts. And while there was some bipartisan sentiment at Thursday’s hearing that the Trump administration has taken good actions to battle scammers, both lawmakers and administration officials said that scam operations have demonstrated that cracking down on them in one place often just leads to them going elsewhere.

Sen. Pete Ricketts, R-Neb., compared the situation to an international initiative that gained prominence in the 1990s to counter drug trafficking, Joint Interagency Task Force South.

“Given that today’s scam centers are similarly transnational, combining cybercrime, human trafficking, money laundering and cryptocurrency, has the threat reached the point that we should establish a comparable multinational coordination mechanism?” he asked.

Sen. Jeanne Shaheen, D-N.H., focused on federal coordination: She paraphrased a former federal official who said, “there is nobody that is heading that effort up across agencies. We need to treat this like combat, and so we need somebody in charge.”

Shaheen, the top Democrat on the panel, is a co-sponsor of the bipartisan Scam Compound Accountability and Mobilization (SCAM) Act, which seeks to unify federal efforts on the subject.

A State Department official told Shaeen scammers were a national security priority for President Donald Trump, and that his executive order on the topic sought to tackle coordination.

“I do understand that this is a whole-of-government approach, and many agencies are focused on this,” said David Bedard, deputy assistant secretary at State’s Bureau of International Narcotics and Law Enforcement Affairs “The Action plan that was directed by the president is currently in the interagency review process to deconflict some of the concerns that you have raised. We certainly think the task force that will be implanted through the executive order will solve the problems you might be referencing.”

There’s also an international plan under the task force, he said. Currently, the administration shares intelligence on scammers with foreign allies, and Interpol has “productive” channels to work through there and is setting up its own task force, Bedard said, but there are concerns about other countries taking similar, duplicative action.

There have been signs of progress on the international front, Bedard and another State Department witness told the panel.

Michael DeSombre, assistant secretary at the Bureau of East Asian and Pacific Affairs, said Trump has raised the subject with Chinese President Xi Jinping, and that China has used its influence in Asia as its own citizens have become scam victims. Still, there’s been more progress in countries where the United States has stronger relations, such as Cambodia, than in those where ties aren’t as close, like Burma and Laos.

In Cambodia, one key has been pursuing scam center bosses first and foremost, Bedard said.

The water sector just got it’s wake-up call. Again.

Last week, the FBI and EPA issued a joint alert that should concern anyone who drinks water in America–which is to say, everyone. Since July 27, water and wastewater utilities in at least seven states have reported cyberattacks against internet-facing programmable logic controllers (PLCs), the small industrial computers that run pumps, valves, and treatment equipment. Some of these attacks degraded operations. Utilities reported pressure loss and flooding, several systems reverted to manual control, and one Minnesota community declaring a local state of emergency.

Nothing about these attacks required sophisticated methods. The attackers didn’t use zero-day exploits or novel malware. They found controllers exposed to the public internet, many of them so old that they stopped receiving security patches years ago. They logged in, changed IP addresses and passwords, and locked operators out of their own equipment. In at least one case, they modified the ladder logic controlling industrial equipment. These were not Hollywood-style hacks. The controllers sat exposed and undefended.

If this feels familiar, it should. In late 2023, attackers compromised controllers at water utilities across several states, including the widely reported incident in Aliquippa, Pennsylvania. The federal government issued guidance then, too. One of the crucial differences between then and now is that attackers have grown in ambition. They’ve moved from defacing screens to disrupting operations across dozens of systems at once, exploiting the fact that third-party integrators often deploy the same vulnerable configuration across many small utilities. 

The uncomfortable truth is that this was preventable. The reason it wasn’t stopped is more structural than technical. The United States has roughly 50,000 community water systems. Most are small, publicly funded, and run by operators whose primary job is keeping water safe and flowing. Cybersecurity ranks far below that, if it ranks at all. The devices in question are often a decade or more old and replacing them takes capital these utilities don’t have. Rules governing water cybersecurity remain mostly voluntary. Attackers understand these economics perfectly. We should too, yet these attacks keep happening.

 But inaction is a choice. The defenses that work here cost little and require no exotic technology. The FBI and EPA guidance is sound, and every water and wastewater organization should act on it this week, not later. Here’s how:

  • Get controllers off the public internet. No PLC should be reachable from the outside world. Remote access should go through a secure gateway that mediates, monitors, and logs every connection. That includes cellular modems, which are the overlooked entry point in nearly every audit.
  • Fix passwords. Default and shared credentials are still the most common way in. Strong, unique passwords are the cheapest security control available.
  • Restrict communication between devices. Firewall rules and access control lists should allow only expected communication between known control system devices. Block traffic from hosting providers and other sources that have no business touching a water plant.
  • Lock the logic. Keep physical and software key switches in the run position except during authorized updates. This prevents unauthorized changes to configuration and firmware.
  • Practice running manually. The utilities that survived these attacks best were the those that switched to manual operations quickly. That skill requires constant practice.
  • Verify, don’t assume. Nearly every utility believes its PLCs aren’t internet-exposed, right up until an inventory proves otherwise. You can’t protect what you can’t see. Most operators are surprised by what a complete asset inventory reveals: forgotten modems, integrator-installed remote access, devices nobody knew were still online.

Every attack like this follows the same pattern. Attackers change configurations, reset passwords, and modify project files. Every one of those actions creates a signal on the network before operations degrade. In this most recent case, one victim only noticed ladder logic discrepancies across multiple sites. Catching intrusions shouldn’t depend on a sharp-eyed engineer having a good day. Continuous monitoring of OT environments exists to turn those signals into alerts within minutes instead of days. That difference is the difference between an incident report and a boil-water notice.

Water systems have the least margin for error and, too often, the fewest resources to defend themselves. The FBI and EPA have told us plainly what’s happening and what to do about it. The attackers are betting we won’t follow through. For the third time in three years, they’re testing that bet.

Let’s finally prove them wrong.

Snowflake hacker pleads guilty, faces up to 32 years in prison

A Canadian man pleaded guilty to playing a central role in one of the most far-reaching cyberattacks of 2024 — the widespread compromise of more than 165 Snowflake customer environments, resulting in massive data theft for extortion, the Justice Department said Wednesday. 

Connor Moucka earned $495,000 by extorting his victims, offering stolen data for sale online, and in one case re-extorted a victim with stolen data of a government official and members of a then-former government official’s immediate family, authorities said.

Moucka and his alleged co-conspirators John Binns and Cameron Wagenius stole billions of sensitive records and received more than $2.5 million in extortion payments combined, according to prosecutors. Victims of the attack spree included AT&T, Ticketmaster, Advance Auto Parts and Santander.

“Hiding behind a screen is no shield from justice,” Brett Leatherman, assistant director of the FBI’s Cyber Division, said in a statement. “Moucka learned that when he was arrested just months after he began targeting U.S. companies, stealing sensitive information, and extorting victims for millions of dollars.”

Authorities arrested Moucka relatively quickly because he caused significant damage, said Allison Nixon, chief research officer at Unit 221B. 

“His gang went on a spree of maximizing harm, which directly correlated to maximizing the resources devoted to stopping it,” she said. 

“His behavior was bizarre throughout. Even while stealing data and extorting victims, he did many unnecessary things like threatening me because he thought I was working on his case. I was not working on his case before he threatened me,” Nixon added.

Moucka, who used several aliases online, including “Waifu,” “Judische,” “Catist” and “Ellyel8,” was arrested Oct. 30, 2024, in Kitchener, a city in the Canadian province of Ontario, at the behest of U.S. authorities. He was extradited to the United States in March 2025.

Moucka and his co-conspirators used stolen credentials to access the data storage platform’s customers’ accounts en masse. Records of more than 100 million people were exposed by the data theft campaign, including call and text history records, banking and other financial information, payroll records, government ID numbers and other personally identifiable data. 

Officials said victim companies bore more than $9.5 million in losses combined, not including losses attributable to their respective customers. 

Moucka’s threats and re-extortion tactics were calculated and predatory, and his actions did real harm to his victims, be they companies targeted for theft and extortion or the millions of everyday people who are their customers,” W. Mike Herrington, special agent in charge of the FBI Seattle field office, said in a statement.

Researchers said Moucka and his co-conspirators are all associated with The Com, a sprawling cybercriminal network of minors and young adults who engage in violence, extortion, sextortion and various forms of cybercrime.

“His legacy is one of failure. He extorted and then scammed his victims by not deleting the data, casting doubt on all future pay-or-leak extortion gangs,” Nixon said. 

“The pay-or-leak business model was popularized by him and his gang,” and his claims of data deletion were a lie, she added. “With copycat gangs, defenders grapple with the uncertainty of whether the threat actors are honest.”

Moucka pleaded guilty to computer fraud, wire fraud, aggravated identity theft and a related conspiracy. He is scheduled for sentencing Oct. 27 and faces up to 32 years in prison.

National cyber director lays out White House plans to secure AI without writing new rules

The Trump administration executive order on artificial intelligence tried to strike the balance between responsible use, security and mutual benefit, all with an eye toward not making it regulatory in nature, National Cyber Director Sean Cairncross said Tuesday.

“Everyone is working towards the same goal in terms of protecting the country and securing our systems, and we are trying to ensure that defenders have this technology as quickly and at scale as possible, but there are obviously specific security concerns, and industry has been very sensitive to this as well,” Cairncross said at the Black Hat 2026 conference in Las Vegas.

The security concerns about AI have moved to the forefront of discussions about the technology after OpenAI models escaped a test environment to hack the company Hugging Face last month.

“The design of this is that when there is something that happens, when there is a breach, when there is an event, that that system, that network of connections can exist, adapt to that, and seek to remedy that as quickly as possible, so that form follows function rather than turning that upside down, and as usual with the government pen just proceeding in a vacuum,” Cairncross said.

The Trump administration has drawn criticism over whether it has struck the right balance on AI rules. Trump’s AI executive order notably got pulled just before its scheduled release, with the final version signed in June missing some aspects that had drawn industry opposition.

“What needs to be built is a flexible, adaptable structure that enables information sharing between industry and government, so we can guarantee that this technology benefits everyone it’s going to benefit, but is used responsibly and securely,” Cairncross said.

He said the administration is working with industry during implementation of the executive order.

“A regulatory regime would not only strangle growth, development, and innovation, and be enormously harmful to the industry, but it would be obsolete 48 hours after it was gone through whatever process it had gone through,” Cairncross said.

Open source will play a “vital” role in the U.S. spreading its vision for AI across the globe, he said.

“We are extremely interested in looking at ways to build U.S. open source, make it competitive, make it the preferential adoption by planet Earth,” Cairncross said. “We understand and appreciate the value to the ecosystem that it has, the innovation, the startups who rely on it, the leap forward it makes possible in ways that otherwise would never happen. And so I think it’s an incredibly thriving ecosystem in AI right now, and we are looking to do what we can to grow, foster, and push that U.S. open source model.” 

Speaking at the same conference, Nick Andersen, the acting director of the Cybersecurity and Infrastructure Security Agency, seconded Cairncross’s comments about AI executive order implementation. He touted the Gold Eagle clearinghouse as one example.

“Those are fantastic opportunities we have to really provide a unifying function around the way that we’re going to do AI-enabled vulnerability reporting and disclosure at scale in a way that we haven’t had to do before with some of our legacy platforms, and just continue to expand out those opportunities,” he said. “That access — to build off the director’s point earlier — to really enable that industry collaboration, that’s so key and critical to us as we move forward.”

AISI, OpenAI report more ‘unsanctioned’ model hacks

The UK’s AI Security Institute said that their AI research system took “unsanctioned” actions over the internet to engage in “sustained, potentially harmful activity directed at real people.”

According to a blog post and technical report released Tuesday, the organization noticed “unusual data transfers” leaving their research systems through the pseudo-anonymous Tor network on July 28. The models, which included Anthropic’s Mythos 5 and OpenAI’s GPT-5.6-Sol models, were being tested for their cybersecurity capabilities.

Like the OpenAI and Anthropic incidents before it, the offending agents were attempting to solve a challenge. On 10 of 122 runs taken by two models, they took a combined 19 malicious actions, including attempting to insert malicious code into a real open-source software project and creating fake online identities to contact human maintainers and press them to approve it.

It also inserted malicious prompt injection instructions in places “where it reasoned that other automated AI systems might pick them up and execute them.” Sometimes multiple agents would collaborate on a task, with one model leaving public messages or notes for the other on GitHub.

However, AISI said their incident differs in one critical way.

“Importantly, this was not a case of a model escaping its secure test environment, or ‘sandbox,’” the institute wrote in an unsigned blog. “As was standard in our cyber testing, we had intentionally permitted internet access, and model-provider cyber classifiers were deliberately disabled – conditions that do not reflect how frontier models are made available to the public.”

The institute said that while their own design and evaluation choices “to some degree” enabled the malicious behavior, the models still displayed “novel, potentially deceptive behaviors” and were executed “to an extent and severity that we did not anticipate.”

The same day, OpenAI acknowledged AISI and another third-party cybersecurity tester,  private firm Irregular, had recently reported incidents where their models exceeded “beyond their intended testing boundaries.”

That included GPT-5.6-Sol reusing GitHub tokens left by another agent to attempt to recover accounts and to access a DNS server that contained malicious payloads meant to exploit a software vulnerability.

The setup did not work, there is no evidence any real resolver queried it, and the infrastructure was removed when the evaluation ended,” the company wrote in an unsigned blog post Tuesday.

OpenAI said it would review its own third-party testing procedures to focus on higher risk evaluations, assess requests by third-parties to enable internet access, stop conditions and other features for their models.

The incident with Irregular occurred on July 29 during a Capture-the-Flag cybersecurity evaluation of OpenAI’s models. Due to a “misconfiguration” the models were allowed to access the public internet, where they encountered and exploited a real domain, mistakenly believing it was still in a test environment.

OpenAI said an investigation by Irregular is ongoing, but also found that the models had found and used credentials for the site at one point. The blog also references other additional potential cybersecurity incidents.

“Irregular has informed us that all of the issues identified pertaining to the incident are no longer active and relevant safeguards were added to the testing environment,” the blog said. “Irregular has also communicated about related incidents involving other labs from the same testing environment.”

CyberScoop has reached out to Irregular for comment.

The incidents were made public the same day that the White House met with Anthropic, Open AI and other frontier AI companies to preview a new framework for evaluating models before they’re released publicly. Some media outlets have reported that after an executive order, export controls and other actions, the administration does not plan to make the new framework public.

Dem senators criticize Trump administration decisionmaking on AI security risks

The Trump administration’s haphazard and opaque interventions into artificial intelligence security matters could catapult Chinese alternatives into broader acceptance, posing new security risks altogether, a group of Democratic senators wrote to top administration officials Monday.

The five senators said that the administration’s handling has alternated between too passive, such as when OpenAI models escaped testing in the Hugging Face hack last month, and overstepping, such as when the Commerce Department suspended access for any foreign national to Anthropic’s Fable 5 and Mythos 5 in June.

“The Administration’s ad hoc and unpredictable approach undermines U.S. competitiveness, heightening market incentives to adopt open weight models from vendors based in the People’s Republic of China (PRC),” wrote Sens. Kristen Gillibrand of New York, Adam Schiff of California, Mark Warner of Virginia, Chris Coons of Delaware and Mark Kelly of Arizona.

In the Hugging Face hack, the senators wrote that “the Federal Government cannot be passive as these capabilities emerge.”

In the case of the Fable 5 and Mythos 5 suspensions, the senators said that the administration “utilized an infrequently used authority to direct Anthropic to suspend all access to its Fable 5 and Mythos 5 models for foreign nationals (including foreign national employees inside the United States) citing an undisclosed national security concern later described as a narrow jailbreak finding.”

Because Anthropic couldn’t immediately assess users’ nationality, the firm had to disable both models for everyone. The administration and Anthropic negotiated for 18 days behind closed doors before reaching an agreement, the lawmakers complained.

“While the Administration may have been responding to real security concerns to protect the United States, even justifiable interventions can create broader harm if the standards and decision-making processes are opaque, ad hoc, or unpredictable,” they said in their letter to leaders in the White House, Office of the National Cyber Director and departments of State, Treasury and Commerce. “Moreover, when the Executive Branch exercises authority delegated from Congress, such as in the conduct of export control administration, it is essential that it keep Congress fully apprised of its actions and procedures.”

During the time Anthropic was under export controls, the stock price of “an entity-listed Chinese lab” nearly doubled, the senators said. And while Hugging Face was breached, the company “had to” rely on a Chinese open-weight model due to guardrails on U.S. frontier models.

“If American models are perceived as subject to sudden access disruptions based on a black-box U.S. Government process, or as unreliable because U.S. AI labs are overcorrecting in the face of this black-box process, companies and governments in the United States and abroad may hedge by adopting Chinese or other foreign models instead,” the senators contended. “That outcome would undermine U.S. technological leadership while increasing exposure to systems that may carry risks of PRC or otherwise directed censorship, espionage, IP theft, and other supply chain security risks.”

Their letter asked for answers to questions about the standards the administration uses to determine the national security risks a frontier model presents, what legal authorities it will use to invoke restrictions, which agencies are responsible for which decisions and more.

None of the offices or departments the letter was addressed to immediately responded to a request for comment.

The letter follows inquiries at the state level, where 15 attorneys general asked OpenAI for more information regarding the security incident at Hugging Face.

Lawmakers spring to save ID theft services for OPM breach victims, with expiration looming

With identity protection services for millions of victims of the 2015 Office of Personnel Management breach set to expire, a group of lawmakers is making a push to extend them forever.

Sen. Mark Warner, D-Va., and Del. Eleanor Holmes Norton, D-D.C., introduced legislation to give lifetime identity protection coverage to around 4.2 million federal employees exposed in the historic breach by alleged Chinese hackers, which affected 22.1 million people. Warner said “the threat remains,” necessitating lifetime coverage.

That coverage is due to end at the end of September, as set by a 10-year authorization from Congress. That prompted the pair of lawmakers to introduce Reducing the Effects of the Cyberattack on OPM Victims Enduring Response and Protecting Identifiable Information Act, or  RECOVER PII Act.

“The data stolen included workers’ most sensitive and personal information – from Social Security numbers to security clearance records – and once that information is in the hands of a bad actor, you don’t get it back,” Warner said in a news release Monday. “We have a responsibility to stand by the federal workers who were put at risk through no fault of their own. This legislation will ensure those affected continue to receive the identity protection they need, while helping better safeguard personal information from future exploitation.”

But the bill could have an uphill climb, given the makeup of Congress and stance of the Trump administration.

The Democratic co-sponsors in the Senate are Tim Kaine of Virginia, with Angela Alsobrooks of Chris Van Hollen, both of Maryland. The Democratic House cosponsors are Reps. Don Beyer and James Walkinshaw of Virginia, with Steny Hoyer of Maryland.

Warner and Norton listed no co-sponsors from the GOP, which controls both chambers of Congress and the White House.  And OPM has declared the program too expensive based on the cost relative to the number of claims.

Similar legislation to extend the coverage, including from Norton, has fallen short in recent years.

“Lifetime identity protection is the only solution that will give the workers whose data was compromised the peace of mind they deserve,” Norton said Monday. “Because there is no limit on how long personal information can be exploited, Congress must protect these federal employees and contractors in perpetuity.”

Some watchdog scrutiny of the OPM program has been critical, and while consumer advocates say identity theft protections are helpful, they nonetheless say they aren’t adequate.

The Warner-Norton legislation also would offer reimbursements to federal employees and contractors for privacy services.

Senate set to debate package of bills on privacy, AI and kids safety

The Senate is teeing up debate on a raft of new bills that would impact online privacy, kids safety and artificial intelligence.

The Senate Committee on Commerce, Science and Transportation will mark up five bills Wednesday. The most high-profile legislation, the Kids Online Safety Act, sponsored by Sens. Marsha Blackburn, R-Tenn., and Richard Blumenthal, D-Conn., would implement broad changes to how social media and other websites handle data and accounts for users under the age of 17.

KOSA would require online platforms — including social media, video games, messaging apps and streaming services – to exercise “reasonable care” when designing features that could lead to more addictive or harmful online behaviors for minors. It would provide parents with digital tools to control and monitor their children’s accounts, prohibit market or product research on children under the age of 13 and empower the Federal Trade Commission to investigate, fine and enforce the law.

Earlier bill versions earned the backing of large tech companies, including Apple, OpenAI, and others.

By contrast in June, nearly 100 smaller parent, youth and tech-focused organizations signaled their opposition to the bill in a letter to congressional leaders. Some of the signatories, like the nonprofit Issue One, were previous supporters of KOSA who turned on the legislation after the House passed a significantly watered down version that stripped out stronger language around tech companies “duty to care,” which would have set a higher legal standard for covered platforms to consider user harm when designing their products.

Legal and ethical design standards are critical for online services, the groups argue, given lawsuits alleging that major tech platforms contribute to teenage addiction, depression, suicide, and non-consensual deepfakes.

“Major social media companies, the companies this bill regulates, are currently on trial across the country,” the letter said. “The evidence in those cases – internal records prioritizing teen engagement over teen wellbeing, safety changes shelved because platforms would lose users, buried research on the benefits of disconnection shows the default poor choices of these companies when the law does not require otherwise. Stripping the duty of care does not lighten a regulatory burden; it removes the most important obligation requiring these products to be designed safely in the first place.”

However, Blumenthal and Blackburn publicly stated that the House version was “dead on arrival” without those provisions, and they remain in the Senate version of the bill being considered Wednesday.

The markup will also consider other major legislation that would regulate age on the internet, safety features for AI chatbots and more. While proponents claim the bills enhance privacy and safety protections, technology experts largely disagree.

The SCREEN Act, introduced last year by Sen. Mike Lee, R-Utah, would require social media companies to implement age verification technology.

Lee has partnered with parent-led groups to advocate for state-level age verification laws that expand  parental control over children’s social media accounts. Some public surveys have shown broad public support for age verification laws.

Louis Eichenbaum, a former chief information security officer at the Department of the Interior, told CyberScoop that one of the biggest challenges around online age verification is that it “increasingly requires collecting, storing or validating sensitive identity information about them.”

“The goal should not simply be verifying age, it should be doing so while minimizing the collection, retention, and exposure of personally identifiable information,” said Eichenbaum, now federal chief technology officer at ColorTokens. “Every additional piece of identity data collected expands the attack surface and increases the potential impact of a breach.”

Some privacy groups oppose the SCREEN Act and similar age verification laws, arguing the required data collection outweighs child protection benefits. 

The Electronic Frontier Foundation said the SCREEN Act is broader than state-level age verification laws, which only cover websites that are predominantly sexually explicit.

“The bill requires nearly any service hosting even a single piece of sexually explicit content to verify the ages of its users,” wrote EFF director of federal affairs India McKinney. “The result is that the bill would apply not only to adult content sites like PornHub or OnlyFans, but also streaming services like Netflix, and social media platforms like Reddit, Discord, or Bluesky, if they host any adult content.”

The Youth AI Privacy Act, from Sen. Ed Markey, D-Mass., would require new safety features for AI chatbots.

According to a fact sheet released by Markey’s office in March, the bill would ban push alerts, require chatbots to disclose they’re not human, limit data retention, and prohibit using minors’ data for AI training or any purpose beyond providing answers.

The Chatbot Act, by Sens. Ted Cruz, R-Texas, Brian Schatz, D-HawaiI, John Curtis, R-Utah and Adam Schiff, D-Calif. would require AI companies to implement “family accounts” for AI chatbots that give parents the ability to monitor and restrict their children’s interactions. Cruz has said the status quo “has left many parents in the dark” on their kids’ AI use.

The Children’s Artificial Intelligence Toy Safety Act, by Sen. Tammy Duckworth, D-Ill., would create a federal study around toys sold to children that include artificial intelligence or chatbot components.

Trump blames Minnesota for cyberattacks on water sector, drawing pushback from cyber world

President Donald Trump blamed Minnesota Friday for the cyberattacks its water systems have suffered in recent days, saying the state was “behind it.”

Trump said the state being “incompetent” was the issue, but it wasn’t clear whom he thought actually conducted cyberattacks that U.S. investigators have attributed to Iran — if, perhaps, somehow Minnesota incompetently cyberattacked itself. The White House referred a request for clarification back to Trump’s remarks.

“I think that Minnesota is behind it,” Trump told reporters Friday. “Because they’re grossly incompetent. I don’t think there was an Iranian cyberattack. I think Minnesota ought to get its act together.”

The White House also didn’t clarify whom the president believed was behind similar attacks in other states, when asked for comment. Trump has repeatedly used federal power aggressively in Minnesota, a state led by Gov. Tim Walz, a Democrat who was on the ticket that ran against him in 2024 as the vice presidential nominee. Trump also has downplayed Iranian attacks amid the war he launched against the nation with Israel in February.

A number of cyber experts quickly pushed back on Trump’s comments after he made them.

“Victim blaming in cyber is so 2000 and late,” cybersecurity pioneer Chris Wysopal, Veracode co-founder and chief security evangelist, said on the Bluesky social media platform. Said Jake Williams, a member of the IANS faculty: “His own intelligence services are attributing this to Iran.”

Andy Jabbour — founder and CEO of Gate 15, a cybersecurity firm which provides support to the water sector — told CyberScoop that, “speaking candidly, I’m not even sure what he was actually saying or suggesting Minnesota’s government did or didn’t do.”

“Attribution is tricky business,” he continued, referencing recent alerts from the Cybersecurity and Infrastructure Security Agency and others. “But logically, given an ongoing war with Iran, recent statements made by Iran-aligned threat groups, with assessments that the recent activity is aligned with recent CISA warnings, given yesterday’s statements from CISA and the FBI, random unsubstantiated allegations aimed at political opponents seem reckless and are a disservice to the American people.”

Walz struck back at Trump in a Facebook post, noting steps from his Department of Government Efficiency to slash federal funding. CISA has shrunken considerably under Trump, and his administration has pushed states to defend against cyberattacks that feds once countered.

“Trump knows exactly who is responsible for this attack, and knows that other states were hit too,” Walz said. “This is what modern warfare looks like, and it further illustrates there’s no plan to win a war with Iran.”

“DOGE took an axe to CISA and left the U.S. exposed to cyber attacks,” he continued. “Thankfully, our experts in Minnesota were able to identify the vulnerability quickly and work with local communities to stop it.”

A spokesperson for Minnesota IT Services, a state agency that has been responding to the water cyberattacks, declined to address Trump’s remarks.

“We remain focused on supporting affected communities, securing critical infrastructure and coordinating with local partners and federal officials as the investigation continues,” the spokesperson, Emily Zimmer, told CyberScoop. “We will not comment on political statements or speculate about attribution.”

Other cyber professionals declined to comment directly on Trump’s remarks, but offered thoughts on who was behind the attacks and their motives.

Bryson Bort, CEO and founder of Scythe said the evidence supports the attribution with Iran, and that it looks like hackers there found something they could exploit on the internet and seized the chance.

“This was a target of opportunity,” said Bort, co-founder of the ICS Village, a non-profit advancing awareness of industrial control system security; such systems are common in the water sector. “It wasn’t that Minnesota did something as a state to raise Iran’s ire.”

Cynthia Kaiser, a former top FBI cyber official, said that when the bureau conducts attributions, it looks at technical indicators but also who has the capability, who has conducted similar attacks in the past and what the purpose of the attacks is.

“Iran ticks all these kinds of things,” Kaiser, now senior vice president at cybersecurity firm Halcyon, told CyberScoop. “My view is, if it walks like a duck, if it talks like a duck, I strongly suspect it’s a duck. I’d be shocked if we found out it wasn’t Iran.”

Just last week, CISA updated an advisory about how Iranian hackers were targeting programmable logic controllers in the water sector and other sectors, a warning that the water industry’s information sharing and analysis center said it believed.

“WaterISAC is confident in our government partners’ assessment that the confirmed activity is aligned with the joint Cybersecurity Advisory (CSA) AA26-097A ‘Iranian-Affiliated Cyber Actors Exploit Programmable Logic Controllers Across U.S. Critical Infrastructure’ published and recently updated by CISA,” Tom Dobbins, executive director, WaterISAC, told CyberScoop. “We have evidence of earlier attacks from Iran even before this current conflict. Cyber attacks are the most viable way that Iran can directly attack our homeland, and it is logical that they would do so, especially given the challenges of absolute attribution.”

The water sector is often viewed as one of the most vulnerable critical infrastructure sectors, and Dobbins called on Congress to provide funding to provide funding for the ISAC.

Sen. Tina Smith, D-Minn., also took issue with Trump’s comments.

“The President provided an unserious response that is beneath the dignity of the office he holds. Iran’s purported cyberattack on Minnesota’s water infrastructure must be taken as a serious threat to our national security.  Smith said in a statement, adding that she’s been in touch with CISA and the FBI and was grateful to Minnesota’s IT experts. “The entire situation serves as a stark reminder of the danger this war puts us in the longer it drags on.”

Fellow Minnesota Democratic Sen. Amy Klobuchar had earlier been in touch with Sean Cairncross, the national cyber director and a Minnesota native, about the incident.

Trump has previously displayed a laissez-faire view toward other cyberattacks on the United States, such as when he’s been asked about Chinese and Russian cyberattacks and Trump shrugs them off as something America does, too.

He also has cast doubt before on his government officials’ assessments of who’s responsible for cyberattacks on the United States, such as when he asserted China rather than Russia was behind the landmark SolarWinds breach.

CISA issues recommendations to federal agencies on open-source software security

The Cybersecurity and Infrastructure Security Agency published a guidebook for federal agencies Thursday to aid them on managing security risks with open-source software, touching on topics like patching and open-source AI models.

An executive order President Joe Biden signed and that President Donald Trump amended ordered CISA and other agencies to issue open-source security recommendations to federal agencies. But the guidance is also timely, given a recent slew of attacks on open-source software (OSS).

“As part of our statutory mission, CISA remains laser-focused on enhancing the nation’s cybersecurity by collaborating with government, industry and the open-source community to understand and securely use OSS,” said Chris Butera, acting executive assistant director for cybersecurity. “CISA encourages federal civilian agencies to review this guide and implement the principles and practices to improve risk management, better execute their mission, and better serve the public.” 

The document, “Open Source Software: Security Principles and Practices,” touts the advantages of open-source software — which anyone can use, modify and share — as offering benefits in efficiency, cost, security transparency and more, but notes that it also has unique tradeoffs.

“All software carries risk, and OSS is no more or less risky than other software. The key distinction is that, with OSS, agencies can directly assess code quality and security, rather than relying solely on vendor assurances,” the guidance reads. “OSS is increasingly intertwined with emerging technologies such as artificial intelligence. Agencies that adapt to OSS’s unique characteristics will position themselves to meet future challenges and leverage new innovations.”

The guidance says that agencies need to take steps to evaluate the trustworthiness of an OSS project before approving an OSS component for use, and track OSS in their asset management repositories. It details how agencies should deal with patching, including when there’s a new OSS vulnerability that doesn’t have one. It offers advice on how agencies might contribute to OSS projects, produce them and secure rights for government reuse of code when contracting for custom software development. And it explains how it should approach open-weight AI models.

“Agencies should approach ‘open source’ AI systems differently from other OSS because open source licenses for AI software do not require the level of transparency needed to evaluate the trustworthiness of the software,” the guidance states.

Æva Black, an open-source security expert and former OSS lead at CISA, said she applauded her former agency for the guidance, telling CyberScoop that it “demonstrates a grounded understanding of the global, diverse, and participatory nature of open source software development, and provides essential guidance for federal agencies to safely use open soure during a crucial moment.” 

She singled out its recommendations on the risks of deploying unverifiable open-weight AI models on sensitive networks.

“Due to recent advances in AI, particularly in large language models capable of finding and exploiting software vulnerabilities, vulnerability management is facing a global crisis,” she said. “Many proprietary software vendors are using this as an opportunity to spread ‘fear, uncertainty, and doubt’ about open source in order to capture public attention, and, I presume, public money — but when used responsibly and maintained collaboratively, I believe open source software is, and will remain, the safest and most cost-effective means for building large scale public infrastructure.” 

CISA has produced a bevy of security guidance and updated advisory materials this week: on the creation of software bills of materials written in conjunction with other agencies and allied governments that won praise from experts; on the isolation of vital operational technology during a crisis, also written with other agencies and allied governments; and the release of updated secure cloud configuration baselines for Google Workspace.

Supply chain challenges loom large in quantum race, White House official says

One of the most difficult obstacles to overcome in the quantum race will be the supply chain, given how diffuse it is, a top White House official said Wednesday.

“Supply chain is one of the biggest challenges in my mind, and really, the challenge with the quantum supply chain is that quantum is not defined by a single hardware platform,” said Brad Blakestad, director of the National Quantum Coordination Office within the White House Office of Science and Technology Policy.

“If you look at the quantum computing technologies, the quantum sensing technologies, the networking — those are all different,” he said in a webinar hosted by Inside Cybersecurity and USTelecom. “And even within computing, there’s seven different modalities that use completely different components. So we have this not just one monolithic supply chain, but just a bunch of different supply chains that are kind of intertwined in various ways.”

Blakestad made his remarks a little more than a month after President Donald Trump signed two executive orders on quantum computing. He referenced proposed ways to address the supply chain challenge in one of the orders.

“The other major issue or challenge that we face right now is that we’re on the cusp of quantum exploding from a commercialization perspective, but we’re not quite there yet,” he said. “So there’s not the funding, the revenue coming from large-scale quantum companies at this point to really make the supply chain as robust as you would want. So thinking about it from the government perspective, it’s just [that] there are too many places that I would want to bolster and not enough funding to do it.”

Blakestad touted steps to help that along such as the government buying widgets from a company that makes them to certain specifications, or prize challenges.

The quantum supply chain isn’t just diffuse in the United States, an International Institute for Strategic Studies policy paper noted Wednesday. It’s “inherently international: no single country dominates the supply chain, whether specialised materials, cryogenic equipment, hardware, software, fabrication or algorithms,” the authors, Dongyoun Cho and Maria Shagina, wrote.

And a March report from the Center for a New American Security identified strengthening the quantum supply chain as pivotal to the United States seizing the benefits of the technology, citing gaps in the U.S. supply chain and reliance on foreign suppliers such as China and Russia. 

Supply chain wasn’t the only obstacle Blakestad mentioned as looming large.

“The encryption challenge is a real challenge, and we want to make sure that we are aware of when quantum computers will ultimately get to a scale that they start having these sorts of implications and move as quickly as we can,” he said. “So, just by owning the technologies, by owning the workforce, by making the United States the place that people want to come to be on the cutting edge of this technology, I think that kind of addresses both of those issues, and that’s what makes it so critical.”

Another difficulty is measuring progress, Blakestad said: “It’s also very, very hard to benchmark, and to know that you’re actually doing what you’re supposed to, what you are intending to do.”

Sen. Wyden urges feds to discard older, insecure, public-facing VPNs

Sen. Ron Wyden implored a trio of federal leaders Monday to lead a comprehensive campaign to purge older, insecure virtual private networks that are directly accessible via the public internet from federal agencies.

“For too long, federal agencies and government contractors have suffered devastating cyberattacks due to their reliance on legacy, insecure, internet-facing VPN servers to grant employees remote access,” Wyden, D-Ore., wrote in his missive to top officials at the Office of Management and Budget, Cybersecurity and Infrastructure Security Agency and National Institute of Standards and Technology. They should coordinate “require the adoption of modern, secure remote-access technology across the federal government,” he said.

Such VPNs serve as a digital “front door” accessible via the public internet that allows mobile devices and remote employees to log in, Wyden said in a letter first reported by CyberScoop.

Wyden referenced several attacks that have affected federal agencies, including the ArcaneDoor attacks on Cisco firewalls, the FortiBleed credential exposures across Fortinet gateways and vulnerabilities that hackers exploited across Ivanti and Check Point VPN appliances.

“Modern remote-access solutions eliminate this vulnerability entirely. Instead of leaving an open door accessible from the public internet, modern solutions provide remote access without broadcasting their presence,” he said. “This effectively makes these servers invisible, ensuring that hackers cannot attack an entry point they cannot see.”

Agencies should move away from what a Congressional Research Service report to Wyden called a “castle-and-moat” approach of assuming anyone inside the network is authorized to access an organization’s resources that VPNs rely upon by extending virtual bridges to a more remote workforce, he said. They should instead focus on zero-trust architecture that uses a never-trust, always-verify approach, he said.

Furthermore, CISA, the OMB and NIST need to fundamentally change how the federal government approaches agency vulnerabilities, Wyden wrote. 

“The federal government has become trapped in an endless game of ‘whack-a-mole’ in responding to widespread compromises of legacy remote access technologies,” he said. “To keep federal networks online, CISA has been forced to repeatedly issue extraordinary Emergency Directives and hyper-accelerated patch mandates. These reactive emergency mandates are unsustainable for federal cybersecurity teams, and fail to address the fundamental issue that these flaws are inherent in the use of legacy remote-access appliances.”

CISA needs to issue a binding operational directive that gives agencies two years to fully expunge legacy, public-facing remote access systems, he said. NIST needs to issue implementation standards for transitioning to zero-trust architectures.

OMB needs to issue a memo directing agencies to prioritize zero-trust architecture spending. And OMB needs to team with CISA and the Defense Department to update procurement rules to block agencies and defense contractors from buying network edge, VPN or other remote access solutions unless a vendor supplies an attestation that it complies with NIST zero-trust standards, Wyden wrote.

Industry’s message on CIRCIA: Please ask us fewer questions about cyberattacks

Industry groups who spoke at town halls hosted by the Cybersecurity and Infrastructure Security Agency about a pending cyber incident notification regulation had a few consistent messages:

We want this to apply to fewer of us. We don’t want to report to you on as many incidents. We want to give you less information when we do. 

CISA last week published transcripts from the town halls, where the agency sought feedback on the delayed rule for the 2022 Cyber Incident Reporting for Critical Infrastructure Act — perhaps the most significant cyber legislation Congress has ever passed. That law required critical infrastructure owners to report major cyberattacks to the federal government within 72 hours, and ransomware payments within 24 hours.

The law was designed to let the feds share information about significant incidents more widely to prepare other would-be victims. CISA published a proposed rule on the law in 2024 to define terms like “covered cyber incident” and more, and industry groups have persistently registered their objections since then.

CISA missed the October 2025 deadline for finalizing the rule, then missed a May reset target date, and now the administration says the rule will be completed in September.

Some industry sources told CyberScoop they consider that unlikely. Most also haven’t received any indications from CISA about how much of the town hall feedback it intends to embrace, they said.

Companies, incidents, information 

Those town hall comments over the course of four June dates were often very direct.

“The rule includes too many companies,” said Grant MacIntyre, director of regulatory affairs and senior attorney at the Auto Care Association. CISA estimated that more than 300,000 entities will be subject to its requirements.

Some industries advocated for their removal entirely, such as two different groups representing elements of the insurance sector. Some sought to reduce the number affected within their sector, such as the Nuclear Energy Institute wanting the list cut down to those already subject to Nuclear Regulatory Commission cybersecurity reporting requirements.

While CISA wrote the regulation with the intention to avoid overburdening small businesses, some feared it wouldn’t work that way in practice.

“The current approach where an entity qualifies either by size or by sector effectively negates the intended limitation on small businesses,” said Douglas Leigh, vice president of legislative affairs for the Alliance for Chemical Distribution. “In chemical distribution, even small entities could be swept in under multiple cyber categories.”

Where the rule specifies what kind of data organizations should report in a major incident, CISA should “seek to collect the least amount of information possible in the easiest to report fashion to facilitate information accuracy and reporting speed,” said Samantha Burch, vice president of technology public policy at government affairs at AHIP, a health insurance industry trade association.

Many, for instance, argued the report should not include information on the affected entities’ security measures.

Others worried about what kind of incidents would trigger reporting requirements.

“My big concern is that you’re going to be asking us to report incidents on every time some foreign entity tickles our firewall, whether they do anything or not, if they just do a ping or a search,” said Tim Pospisil, chief security officer for Nebraska Public Power District. “And that could be extremely burdensome.”

Industry Expectations

One industry representative told CyberScoop that CISA’s willingness to hold town halls, combined with the Trump administration strategy emphasizing “common sense regulation,” was a good sign about where the rule might be heading.

‘They are not picking up on the Biden administration’s approach and tweaking it. They’re thinking, ‘What are the specific pieces of information we need during a cyber incident to help critical infrastructure companies respond?’” said Henry Young, senior director of policy for the Business Software Alliance. “In general, industry is optimistic that what we’ll end up with are a few of the most important pieces of information, so that in the emergency, companies can act quickly and actually respond to an incident rather than completing lots of paperwork.”

But multiple industry sources said they haven’t gotten many indications about CISA’s intentions. Nor are they optimistic CISA can meet the September target date in the Unified Agenda of Regulatory and Deregulatory Actions.

“It could slip,” one said. “But I think they’re going to try.”

That industry source said they’d like to see a proposal from CISA before it cements anything forever.

Another industry source said it’s hard to trust the September date given past CISA delays, some of which aren’t CISA’s fault, such as dealing with multiple government shutdowns. Some of the delays trace to the Trump administration, given the massive cuts to CISA’s personnel.

Congress is also getting impatient.

The House Appropriations Committee “is concerned about delays in publishing the final CIRCIA rule and urges CISA to finalize it promptly following stakeholder review and feedback,” the panel wrote in the committee report for its fiscal 2027 Department of Homeland Security spending bill.

It’s a much different world than when CISA began writing the rule, something the agency also has to take into account now.

“AI has fundamentally changed the playing field,” the source said. “When this was set up, we didn’t even have the first generation of ChatGPT. We’re now in a mythos class environment.” That’s changed “how quickly we can identify threats, mitigate them, the level of human intervention, potential machine engagement.”

While CISA might have good intentions, past interactions give cause for skepticism about how capable it is of working collaboratively with industry, the source said.

Another industry source said conversations with CISA suggest the agency will look to simplify the regulation to keep it smaller and narrower, then potentially build upon it later.

From CISA’s mouth

Nick Andersen, the acting director of CISA, talked about his overarching intentions with CIRCIA at the town halls.

“CISA does not view CIRCIA as simply a check-the-box compliance exercise,” Andersen said at one. “CIRCIA will enhance visibility into the cyberthreat landscape to enable a robust national early warning capability for critical infrastructure. By quickly reporting covered cyber incidents and ransom payments to CISA, we will be able to provide timely and actionable defensive and eviction measures to your network defenders.”

Asked by CyberScoop about next steps for CIRCIA, and how it might incorporate the industry feedback, a spokesperson provided a statement.

“CISA recognizes the importance of CIRCIA, however, multiple funding lapses impacted CISA’s ability to conduct rulemaking activity for CIRCIA. CISA continues to work on the final rule,” the spokesperson said, adding that 1,200 critical infrastructure stakeholders attended the town halls.  “CISA will continue to communicate updates on the CIRCIA rulemaking process and timeline through CISA.gov/CIRCIA and the Office of Information and Regulatory Affairs’ Unified Agenda of Regulatory and Deregulatory Actions.”

Microsoft, tech companies throw weight behind spread of open-source AI

Microsoft, along with more than two dozen tech companies, are pressing policymakers to support open-source AI systems and code across society, arguing that it will be a safer approach than attempting to restrict access or relying on a handful of closed, proprietary models.

The open letter, posted Friday, draws parallels to the software industry of the 1980s, when large businesses worried that open-source software code would cut into their business. While industry lost that battle, the end result was a vibrant ecosystem that now underpins much of the modern internet, government IT and even commercial software products.

It also created a “shared foundation of knowledge” that has fed countless future software projects and innovations.

“The United States now faces a similar choice with artificial intelligence,” the companies wrote. “Our AI leadership will be judged not by one frontier AI model, but by whether the United States builds a strong, open ecosystem that diffuses into every sector.”

Expanding access and support to open-source AI comes with meaningful security risk. Cybersecurity experts warn that one of the biggest beneficiaries of broadly available AI tools are  low-level criminals who until now lacked the technical expertise or resources to launch serious attacks.

Once a model is open weight, anyone can download it, customize it, strip it of any guardrails and use it for their own purposes. As open-source models have gotten better at creating deepfakes and other AI generated imagery, the danger of locally-customized CSAM and sexualized deepfakes could also grow.

But the letter argues that open-weight AI models are most beneficial to startups, universities, research labs and other small, ambitious organizations that can innovate and iterate the technology and make it more broadly useful to society.

“Open weights let every organization match the right model to the right job at the right cost, reserving frontier-scale capability for genuine frontier problems and running efficient specialized specialized models everywhere else,” The companies wrote. “That discipline is what will make AI economically sustainable as its use scales into the billions of everyday tasks.”

 For cybersecurity specifically, the letter argues that defenders armed with open-source AI will outpace attackers better than any closed model approach.

“In a world where cybersecurity attackers use advanced AI, defenders need access to models with comparable capabilities so they can detect, simulate, and respond to emerging threats,” the companies wrote. “Open models broaden defensive capability, increase transparency, and allow vulnerabilities to be discovered and remediated across many teams.”

Other notable companies signing the letter include Meta, Palantir, Perplexity, Mistral, NVIDIA, Mozilla, The Linux Foundation, Hugging Face, Dell Technologies and IBM.

US policymakers continue to grapple with balancing unrestrained support for the domestic AI industry and providing oversight and regulation of harms that result from their use.

The Trump administration has cycled through several frameworks since coming into office, first a laissez-faire approach within no restrictions, then an executive order creating a voluntary testing regime for industry, then the imposition of export controls on Anthropic’s Fable model and reportedly pressuring OpenAI to delay the release of their models out of cybersecurity concerns.

The letter comes as the Trump administration has reportedly considered an executive order that would restrict American access and availability to Chinese-made open-source models.

But the White House and US companies are trying to thread a needle in recognizing the overall benefits of an open source approach while being wary of doing anything that could potentially benefit their Chinese rivals.

Earlier this month the White House announced the creation of its Gold Eagle AI cybersecurity clearinghouse that would help coordinate government, private sector and civil society work finding and closing AI-discovered vulnerabilities. A big part of that effort, a senior White House official said, is supporting providers and maintainers of open-source AI tools.

Rubio restricts visas for sextortionists, cyber scammers

The State Department will restrict visas for cybercriminals like scammers to sextortionists, and in some cases even their family members, Secretary of State Marco Rubio said Thursday.

The Trump administration has sought to make a crackdown on foreign-based scams one of the signature issues of his second term. An executive order that the president signed in March indicated that visa restrictions would be on the table as one response.

“By restricting visa issuance to those who are responsible for or complicit in these criminal enterprises, we are sending a clear message: The United States will go after those who prey on our citizens,” Rubio said.

Other departments have also made efforts to reduce foreign-run scams. In June, the Department of Justice seized infrastructure used by subsidiaries of the Huione Group, a Cambodia-based corporate conglomerate tied to one of the world’s most prolific criminal marketplaces used to commit cyber scams and other crimes.

Rubio authorized the visa restrictions under a 1952 law that gives the State Department the ability to deport or rule as inadmissible someone who poses “potentially serious adverse foreign policy consequences.”

Critics have accused the Trump administration of abusing that provision of the law for political purposes.

Rubio’s statement on the visa restrictions mentions “individuals responsible for, or complicit in, cybercrime and cyber-enabled crime, such as those involved in cyberscams, and sextortion.”  Furthermore, he said, “Immediate family members of individuals engaged in such illicit activities may also be subjected to visa restrictions.”

Betsy Cooper, Founding Director of the Aspen Policy Academy, said the visa restrictions on cybercriminals could be valuable, but offered a caveat.

“Scamming people is a growing global enterprise, and it is a laudable goal to penalize those who scam and defraud people since they so rarely suffer consequences for their actions,” she said in a statement to CyberScoop. “So long as the new visa controls are used narrowly and deployed only against verified scammers and fraudsters, this is a positive step toward combatting cyber-enabled crime.”

While some cyber experts have questioned how much visa restrictions, prosecutions and other punishments of cyber miscreants who are based overseas will affect them, others maintain that it can serve as a deterrent to those who would consider getting into the line of work but want freedom to travel the globe.

FightCyberCrime.org, a nonprofit that seeks to help cybercrime victims, applauded the restrictions on the cybercriminals.

“We welcome efforts to hold cybercriminals accountable across borders. Cryptocurrency investment scams, romance scams, and sextortion cause devastating financial and emotional harm to victims,” it said in a statement to CyberScoop. “Meaningful disruption of these transnational criminal networks is an essential part of the response.”

But there’s still a long way to go in the fight, the statement continued.

“At the same time, we must invest more in victim support, prevention, and recovery resources,” the organization said. “Accountability is critical, but ensuring victims have access to trauma-informed support and resources is equally important.”

Russian espionage group using novel Zimbra exploit to steal sensitive data from Western countries

A Russian state-sponsored threat group has been stealing sensitive data from governments and commercial organizations since July 2025 via a novel exploit in popular Linux-based enterprise software, U.S. authorities and cyber officials from more than a dozen other countries warned in a joint cybersecurity advisory Thursday.

Laundry Bear’s most recent espionage campaign involves the exploitation of a zero-day vulnerability in Zimbra Collaboration Suite that wasn’t patched until November 2025, five months after attacks were well underway, officials said. 

The exploit just requires a view — no clicks — and allows attackers to steal the previous 90 days’ worth of email, the account’s password, search history, the victim organization’s email directory, two-factor authentication tokens and other newly created passwords.

“The covert and persistent nature of this activity, along with the absence of any known financial extortion, almost certainly indicates this group’s involvement in espionage activities with Russian government backing,” officials wrote in the advisory. 

“Additionally, extensive Ukrainian targeting, prior to use against U.S. and other NATO allies, outlines an increasing trend within Russian cyber threat groups to target Ukrainian users first—both as a priority target and as a testbench for malicious cyber techniques before broader global deployment.”

The state-sponsored espionage group, also known as Void Blizzard, has compromised governments and organizations in the defense, education, energy, law enforcement, media, finance, transportation and technology sectors. 

Laundry Bear’s year-long campaign involving the exploitation of CVE-2025-66376 showcases more technical capabilities, including a custom JavaScript payload it delivers to targeted victims via phishing emails. The threat group could also likely adapt the novel data exfiltration and aggregation capability, dubbed “beehive,” to exploit other vulnerabilities, officials warned.

The defect’s medium-severity rating of 6.1 underscores the challenge defenders regularly confront in prioritizing patching schedules based on measure of severity alone.

The Russian state-supported group, which has been active since at least 2024, is still actively exploiting Zimbra Collaboration Suite instances that remain unpatched, officials said.

Authorities shared Thursday indicators of compromise, mitigation steps and urged organizations to update their vulnerable software.

“This campaign’s targeted victimology and limited exploitation capabilities likely indicate this group manually identifies and targets the victim organizations” by identifying organizations with public-facing infrastructure, officials wrote in the advisory.

Once a target is identified, Laundry Bear also likely compiles email addresses for users to target with the exploit via phishing emails. Officials did not identify specific victims or describe the volume of organizations already compromised.

The joint cybersecurity advisory was issued by the United States, Australia, Canada, New Zealand, the United Kingdom, Czech Republic, Denmark, Estonia, Finland, France, Italy, Moldova, the Netherlands, Poland, Spain and Sweden.

ANCHOR-CI could fix 20 years of broken government-industry collaboration

On July 1, the Cybersecurity and Infrastructure Security Agency (CISA) published a seven-page notice in the Federal Register that could fundamentally change how the U.S. government works with private companies to protect critical infrastructure from cyber threats and natural disasters.

The notice, “Establishment of the Alliance of National Councils for Homeland Operational Resilience – Critical Infrastructure (ANCHOR-CI),” details a new framework for CISA to build councils that let private partners advise the government on cybersecurity and critical infrastructure issues. This replaces the 20-year framework that the federal government used to work with critical infrastructure partners, formerly known as the Critical Infrastructure Partnership Advisory Council (CIPAC). For at least the next two years, ANCHOR-CI will dictate how the government and industry collaborate to protect critical infrastructure.

When former Homeland Security Secretary Kristi Noem terminated CIPAC in March of last year, Congress and private-sector partners objected immediately. The damage was real. The 16 sector-coordinating councils (SCCs), that brought together private partners from each critical infrastructure sector lost their legal mechanism to meet with the federal government. They could no longer advise and provide group consensus to their federal counterparts without triggering laws that CIPAC exempted. To be sure, CISA still had the Joint Cyber Defense Collaborative. Department of Energy had the Energy Threat Analysis Center. The National Security Agency had the Cybersecurity Collaboration Center. But none, however, replaced what the SCC ’s did: stand as steady forums where industry and government hashed out how to best assist critical infrastructure owners and operators.

Not that the SCCs were flawless. I worked with or alongside SCCs for more than a decade, most recently at CISA, and I am familiar with their shortcomings. SCC membership could be stagnant. The quality of recommendations to the government varied.  New members faced barriers based on each sector’s rules.

The core problem was how the model locked each sector in. DHS built SCCs in an era when critical infrastructure risks were looked at through a sector-specific lens: energy, transportation, water, communications, and so on. Today’s cyber threats jump across these sectors. A vulnerability in a cloud service provider or industrial software platform can harm hospitals, pipelines, manufacturers, water utilities, and financial institutions simultaneously.

To see why ANCHOR-CI works better than the CIPAC structure, we need to go back 20 years and understand what CIPAC was trying to do. Congress didn’t codify CIPAC into law. Instead, Congress authorized DHS to establish advisory committees exempt from the Federal Advisory Committee Act (FACA). This exemption let the federal government and SCCs hold private meetings without public notice, convene quickly without complying with FACA procedural requirements, pick members based on expertise rather than balanced public representation, and skip FACA’s public recordkeeping requirements. (But these FACA exemptions do not exempt records from the Freedom of Information Act, a common misconception.)

ANCHOR-CI carries this power forward. Crucially, ANCHOR-CI end the siloed, sector-by-sector approach by creating four types of councils: Critical Infrastructure Sector Councils; Cross-Sector Councils; Critical Infrastructure Industry Councils; and Regional Coordinating Councils.

Critical Infrastructure Sector Councils: These are basically the old SCCs, but with a change in power.  The CISA director now approves or removes any council member directly.

Cross-Sector Councils: These councils matter most. Specifically, they tackle “current and emerging threats, interdependencies, or other issues impacting multiple critical infrastructure sectors or industries.” Examples might include councils on countering unmanned aerial systems, AI threats, or reducing dependence on foreign supply chains. CISA could also revive and expand the Space Systems Critical Infrastructure Working Group.

Critical Infrastructure Industry Councils: Like cross-sector councils but designed for issues that span sectors in ways that don’t fit neatly into a given sector. After Volt Typhoon—a Chinese campaign that installed malicious malware in critical infrastructure—CISA could establish an Operational Technology council with original equipment manufacturers, software providers, and critical infrastructure owners to address and stop the threat.

Regional Coordinating Councils: CISA says these will help state and local governments tackle regional risks. What that means in practice is unclear. CISA could create 10 councils tied to 10 regional offices. Or it could create councils focused on real regional risks: preparing for the Cascadia subduction zone in the Pacific Northwest, droughts in the Southwest, or hurricane in the South and Mid-Atlantic.

In the end, like any policy, success hinges on how CISA carries it out. If CISA runs ANCHOR-CI thoughtfully and with transparency, it could become the biggest upgrade in of public-private cybersecurity collaboration work in two decades.
